8. Termination:  Terms of Use Violations; Effect of Termination.

• We reserve the right to suspend or terminate your account if you violate these Terms of Use and Acceptable Use Policies or for any other reason we deem necessary, or with or without reason or cause or advance notice.
• You may terminate your account at any time by following the instructions in your account settings or your contract or service agreement.

  • You agree that Monsoon Mailer in its sole discretion for any or no reason and without penalty may terminate your access and use of our Services, the Monsoon Mailer Platform or any of the other Monsoon Mailer Services or any Account (or any part thereof) that you may have with Monsoon Mailer and remove and discard all or any part of your Account user profile at any time. Monsoon Mailer may also in its sole discretion and at any time prohibit you from accessing and using our Services, the Monsoon Mailer Platform or discontinue providing access to the Monsoon Mailer Platform or any of the other Monsoon Mailer Services or any part thereof with or without notice. You agree that any termination of your ability to access or use our Services, the Monsoon Mailer Platform or any of the other Monsoon Mailer Services or any Account you may have or portion thereof may be effected without prior notice and you agree that Monsoon Mailer will not be liable to you or any third party for any such termination. Monsoon Mailer reserves the right to fully cooperate with any law enforcement authorities or court order requesting or directing Monsoon Mailer to disclose the identity of anyone that is believed to violate these Terms. Any suspected fraudulent abusive or illegal activity may be referred to appropriate law enforcement authorities. These remedies are in addition to any other remedies that Monsoon Mailer may have at law or in equity. As provided herein Monsoon Mailer does not permit copyright infringing activities on the Monsoon Mailer Platform the Site or any of the other Monsoon Mailer Services and Monsoon Mailer shall be permitted to terminate access to the Fundraising Services the Monsoon Mailer Platform or any of the other Monsoon Mailer Services. BY ACCEPTING THESE TERMS YOU WAIVE AND SHALL HOLD MONSOON MAILER HARMLESS FROM ANY CLAIMS RESULTING FROM ANY ACTION TAKEN BY MONSOON MAILER DURING OR AS A RESULT OF ITS INVESTIGATIONS AND/OR FROM ANY ACTIONS TAKEN AS A CONSEQUENCE OF INVESTIGATIONS BY EITHER MONSOON MAILER OR LAW ENFORCEMENT AUTHORITIES.

  • Your only remedy with respect to any dissatisfaction with (i) the Monsoon Mailer Platform or any of the other Monsoon Mailer Services (ii) any term of these Terms or (iii) any policy or practice of Monsoon Mailer in providing Services or operating the Monsoon Mailer Platform or the other Monsoon Mailer Services is to terminate your use of the Monsoon Mailer Platform any of the other Monsoon Mailer Services and your Account (if any). You may terminate your use of Monsoon Mailer Services and your Account (if any) at any time.
• Effect of Termination.
  • If your Account is terminated for any reason or no reason you agree: (a) to continue to be bound by these Terms (b) to immediately stop using the Monsoon Mailer Platform and to remove all payment card logos from your website and wherever else they are displayed (c) that the Right to Use and the License shall automatically terminate (d) that we reserve the right (but have no obligation) to delete all of your information and Account data stored on our servers and (e) that we shall not be liable to you or any third party for termination of access to the Monsoon Mailer Platform deletion of your information or Account data or export of your information or Account data. 

9. Changes to Terms

• We may update these Terms of Use and Acceptable Use Policies from time to time. Changes will be effective when we post the revised terms on our website and/or Knowledgebase.
• Your continued use of Monsoon Mailer  after changes constitutes acceptance of the updated terms.
